An Act to make provision for the regulation of motor vehicles andof traffic on roads and other matters with respect to roads andvehicles thereon; to make provision for the protection of thirdparties againstrisks arising out of the use of motor vehicles; tomake provision for the co-ordination and control of means of andfacilities for transport; to make provision for the co-ordination andcontrol of means of and facilities for construction and adaptationofmotor vehicles; and to make provision for connected purposes.

Section 44. Driving while under the influence of intoxicating liquor or drugs

NOTE

*Previously “imprisonment for a term of not less than three years and not more than ten years and to a fine of not less than eight thousand ringgit and not more than twenty thousand ringgit.”–see subsection 6(a)of Road Transport (Amendment) Act 2020 [Act A1618].

Section 45. Being in charge of motor vehicles when under the influence of intoxicating liquor or drugs

*NOTE

Previously “shall on conviction be punished with a fine not exceeding one thousand ringgit and shall also be liable to imprisonment for a term not exceeding three months and, in the case of a second or subsequent conviction, a fine of not less than two thousand ringgit and not more than six thousand ringgit and shall also be liable to imprisonment for a term not exceeding twelve months” –see subsection 7(a) of Road Transport (Amendment) Act 2020 [Act A1618].

Section 45A. Driving or being in charge of a motor vehicle with alcohol concentration above prescribed limit

NOTE

*Previously “a fine of not less than one thousand ringgit and not more than six thousand ringgit and shall also be liable to imprisonment for a term not exceeding twelve months and, in the case of a second or subsequent conviction, a fine of not less than two thousand ringgit and not more than ten thousand ringgit and shall also be liable to imprisonment for a term not exceeding two years.”–see subsection 8(a) of Road Transport (Amendment) Act 2020 [Act A1618].
**Previously “On a second or subsequent conviction of an offence under this section, the offender shall, unless the court for special reasons thinks fit to order otherwise and without prejudice to the power of the court to order a longer period of disqualification, be disqualified for a period of not less than twelve months from the date of conviction from holding or obtaining a driving licence.”–see subsection 8(b) of Road Transport (Amendment) Act 2020 [Act A1618].

Section 45B. Breath test

NOTE
