Poisons (Sodium Hydroxide) Regulations 1962: Regulates permits, purchase, storage, use and records for sodium hydroxide.
IN exercise of the powers conferred by section 30 (1) of the Poisons Ordinance 1952, the Minister of Health and Social Welfare hereby makes the following Regulations:
Regulation 1. Citation
These Regulations may be cited as the Poisons (Sodium Hydroxide) Regulations 1962.
Regulation 2. Interpretation
- In these Regulations—
- "permit"
- means a permit in the Form A set out in the schedule to these regulations;
- "sell"
- does not include a sale in the circumstances set out in paragraph (a), (b), (c) and (j) of section 11 (2) of the Poisons Ordinance 1952;
- "sodium hydroxide"
- includes any substance containing not less than twelve per centum of sodium hydroxide.
Regulation 3
- A person who—
- (a)sell sodium hydroxide to a purchaser who does not holds a permit to purchase it; or
- (b)buys sodium hydroxide from a seller who does not holds a licence to it,
commits an offence

Regulation 4. Issue and duration of permit
A permit to purchase, store and use of sodium hydroxide may be issued by the Director of Medical Services, or any Licensing Officer of the Medical Department authorised in writing by the Director of Medical Services. Such permit shall state the maximum quantity of sodium hydroxide that may be purchased and the purpose for which it is required, and shall expire on 31st December after the date of issue.
Regulation 4A. Fee for permit
- (1)Every application for a permit shall be accompanied by a fee of one hundred ringgit.
- (2)The fee which has been paid under subregulation (1) shall not be refundable.
Regulation 5. Particulars of sale
- A person who sells sodium hydroxide shall enter the following particulars in the Poisons Register and on the back of the permit produced by the purchaser:
- (a)the date of sale;
- (b)the quantity sold; and
- (c)the name and address of the seller.

Regulation 6. Retention or return of permit
A person who sells sodium hydroxide shall retain the permit if the total amount permitted has been purchased and shall forward it to the Director of Medical Services or the Licensing Officer. If an amount less than the permitted amount has been purchased the permit shall be returned to the purchaser after the required particulars have been entered in accordance with Regulation 5 of these Regulations.
Regulation 7. Penalty
Whoever contravenes the provisions of these Regulations commits and offence punishable under section 27(2) of the Poisons Ordinance 1952.

This permit is issued subject to the provisions of the Poisons Ordinance 1952, and the Poisons (Sodium Hydroxide) Regulations 1962, and shall expire on 31st December after the date of issue. It should be surrendered to the person from whom the last purchase of Sodium Hydroxide is made when the total amount permitted has been purchased.
