Order 1. Citation
This order may be cited as the Occupational Safety and Health (Exemption for Plant Requiring Certificate of Fitness at the Place of Work of PETRONAS within Maritime Zones) Order 2024.
Order 2. Interpretation
In this Order—
“plant requiring certificate of fitness” has the meaning assigned to it in the Occupational Safety and Health (Plant Requiring Certificate of Fitness) Regulations 2024 [P.U. (A) 99/2024];
“PETRONAS” means Petroliam Nasional Berhad as referred to in subsection 3(1) of the Petroleum Development Act 1974 [Act 144];
“recognized standard” has the meaning assigned to it in the Occupational Safety and Health (Plant Requiring Certificate of Fitness) Regulations 2024.;
“maritime zones” has the meaning assigned to it in the Baselines of Maritime Zones Act 2006 [Act 660].
Order 3. Exemption
The Minister exempts every plant requiring certificate of fitness at the place of work owned by PETRONAS within the maritime zones from the application of sections 27C, 27D and 27E of the Act and the Occupational Safety and Health (Plant Requiring Certificate of Fitness) Regulations 2024.
Order 4. Conditions of exemption
The exemption under paragraph 3 is subject to the conditions that PETRONAS shall—
(a)
establish a regulatory body for the purposes of management of every plant requiring certificate of fitness at the place of work owned by PETRONAS within the maritime zones;
(b)
submit its annual work plan in respect of the management of the integrity of the plant requiring certificate of fitness to the Director General;
(c)
ensure that the plant requiring certificate of fitness is designed, constructed, installed, tested and inspected in accordance with recognized standard;
(d)
ensure that only qualified individuals are in charge of or involved in the installation, erection, dismantling, testing, inspection, maintenance, repair, servicing, operation or handling of, or attendance on, the plant requiring certificate of fitness;
(e)
ensure that the plant requiring certificate of fitness is inspected by an inspector who has been verified by the Director General;
(f)
ensure that any record relating to the plant requiring certificate of fitness is properly maintained and shall be submitted for inspection upon direction by the Director General.
