Competent Person and Training Provider Fee Regulations 2024: Prescribes the processing, registration, and renewal fees for OSH competency registrations.

IN exercise of the powers conferred by paragraph 66(2)(q) and sections 31C and 31E of the Occupational Safety and Health Act 1994 [Act 514], the Minister makes the following regulations:

Regulation 1. Citation

• These regulations may be cited as the Occupational Safety and Health (Fee for Registration of Competent Person and Registered Training Provider) Regulations 2024.

Regulation 2. Fee for registration of competent person

• (1)
  Any person who makes an application for registration as a competent person under section 31C of the Act shall pay a processing fee as specified in column (3) of the First Schedule.
• (2)
  After the application under section 31C of the Act is processed and approved, the applicant shall pay a registration fee as specified in column (4) of the First Schedule before being registered as a competent person.

Regulation 3. Fee for registration of registered training provider

• (1)
  Any person who makes an application for registration as a registered training provider under section 31C of the Act shall pay a processing fee as specified in column (3) of the Second Schedule.
• (2)
  After the application under section 31C of the Act is processed and approved, the applicant shall pay a registration fee as specified in column (4) of the Second Schedule before being registered as a registered training provider.

Regulation 4. Renewal fee

• Subject to section 31E of the Act, a competent person and a registered training provider may renew their registration by paying a renewal fee as specified in column (4) of the First Schedule and in column (4) of the Second Schedule respectively.

Regulation 5. Mode of payment

• Any payment under these Regulations shall be paid—
  • (a)
    by cash;
  • (b)
    by money order, postal order or bank draft made payable to the Director General of the Department of Occupational Safety and Health (DOSH) Malaysia or Director of the Department of Occupational Safety and Health (DOSH) States and crossed with the words 'Account Payee Only'; or
  • (c)
    by credit card, debit card or electronic fund transfer.

Regulation 6. Waiver of fee

• The Director General may, in his discretion, in any particular case, waive wholly or in part any fee specified in the Schedule.
